Terms of Service for Wildlife Learning Encounters, also known as Wildlife Encounters.

Acceptance of Terms

By using wildlifefeencounters.org (collectively the "Site") please read the following terms carefully. BY USING THIS SITE, YOU ACKNOWLEDGE THAT YOU HAVE READ AND AGREE TO THESE TERMS. Wildlife Learning Encounters (Wildlife Encounters) may revise these terms from time to time. If you continue to use our Site after we post changes to these terms, it will mean that you accept such changes.

Website Terms and Conditions

YOUR USE OF THIS SITE IS AT YOUR OWN RISK. THE CONTENT IS PROVIDED “AS IS” AND WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESSED OR IMPLIED.

Use of the Wildlife Learning Encounters website is at the discretion of the user. UNDER NO CIRCUMSTANCES SHALL WILDLIFE LEARNING ENCOUNTERS, ITS TRUSTEES, OFFICERS, INDEPENDENT SUBCONTRACTORS, SUBCONTRACTED COMPANIES, AFFILIATES, EMPLOYEES, MEMBERS OR AGENTS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES THAT MAY RESULT FROM THE USE OF, OR THE INABILITY TO USE, WILDLIFE ENCOUNTERS MATERIALS, INCLUDING THOSE COMPRISING OUR WEBSITE. The user specifically acknowledges and agrees that Wildlife Learning Encounters is not liable for any defamatory, offensive or illegal conduct of any user. If the user is dissatisfied with any of the Wildlife Learning Encounters materials, or with any of the our terms and conditions, the user's sole and exclusive remedy is to discontinue using or visiting the Wildlife Encounters website.

You assume risk using any 3rd party conference software, program or app to connect via our virtual presentations. This includes programs such as ZOOM, Microsoft Teams, StreamYard, YouTube, Facebook and any other similar program. We are not responsible for any loss of information, compromised systems, computers, software, etc when using any of these or similar programs.

All presentations scheduled online using our online reservation system are subject to our approval. Scheduled presentations may have to be changed and/or canceled depending on numerous factors including location of program, time, distance of travel and other factors.

Safe Environment For Animals, Presenters & Guest: 

Client agrees to provide a safe environment for our animal ambassadors, presenters and guest.  This includes but not limited to: appropriate temperatures for animals (not too hot or cold), open area to set up, access to electricity when needed and any other variable needed for the animals, presenters and/or guest. 

Many of our animals diets include peanuts, tree nuts, milk, eggs and other possible allergens.  Please be aware and ensure any persons who may have an allergic reaction does not come into contact with any possible allergens directly or indirectly.  

Client will ensure anyone who participates in feeding, touching or handling any animals will wash their hands with soap and water immediately after coming into contact with any animal.

Client agrees to supervise children at all times.

Animal Request

Wildlife Learning Encounters will do our best to have any requested animals visit for the program, but can never guarantee a specific animal/animals.  Our animal ambassadors create their own schedules of when they want to visit for a program.  A variety of factors can determine which animal ambassador can visit for each event.  

Cancellations

If Wildlife Learning Encounters needs to cancel due to unsafe traveling conditions the client will receive a full refund or reschedule the program date and time, whichever the client prefers.  Unsafe weather conditions can include but not limited to; hazardous road conditions (ice, sleet, snow, etc), extremely cold weather, tornadoes, and blizzards.  

Release of LiabilityWildlife Encounters will not be held liable for any damage caused by the animals, presenters or guests.

ON MY OWN BEHALF, AND ON BEHALF OF MY CHILD, dependents, I HEREBY FOREVER RELEASE, COVENANT NOT TO SUE, DISCHARGE, INDEMNIFY, AND HOLD HARMLESS Wildlife Learning Encounters (INCLUDING ITS SUCCESSORS, ASSIGNS, CURRENT AND FORMER OFFICERS, EMPLOYEES, INDEPENDENT CONTRACTORS, BOARD OF DIRECTORS, VOLUNTEERS, SERVANTS, AGENTS, ATTORNEYS, INSURANCE CARRIERS, AND SELF-INSURANCE POOLS) FROM ANY CLAIMS, AND WAIVE ANY AND ALL RIGHTS TO ASSERT SUCH CLAIMS, INCLUDING ANY AND ALL LIABILITIES, ACTIONS, DAMAGES, COSTS, OR EXPENSES OF ANY KIND OF EVERY NATURE ARISING OUT OF OR RELATING THERETO.

Covid-19
By using Wildlife Encounters services you are agreeing to the following:

I accept sole responsibility for any injury to my child or myself or any member of my household (including, but not limited to, personal injury, illness, disability, and death), damage, loss, claim, liability, or expense, of any kind arising from infection or exposure to any contagious disease, including the coronavirus, that I or my child or any member of my household may experience or incur arising out of or related to with services provided by Wildlife Encounters or participation in Program activities (“Claims”). ON MY OWN BEHALF, AND ON BEHALF OF MY CHILD, I HEREBY FOREVER RELEASE, COVENANT NOT TO SUE, DISCHARGE, INDEMNIFY, AND HOLD HARMLESS Wildlife Learning Encounters (INCLUDING ITS SUCCESSORS, ASSIGNS, CURRENT AND FORMER OFFICERS, EMPLOYEES, INDEPENDENT CONTRACTORS, BOARD OF DIRECTORS, VOLUNTEERS, SERVANTS, AGENTS, ATTORNEYS, INSURANCE CARRIERS, AND SELF-INSURANCE POOLS) FROM ANY CLAIMS, AND WAIVE ANY AND ALL RIGHTS TO ASSERT SUCH CLAIMS, INCLUDING ANY AND ALL LIABILITIES, ACTIONS, DAMAGES, COSTS, OR EXPENSES OF ANY KIND OF EVERY NATURE ARISING OUT OF OR RELATING THERETO. I agree that presentation of this Release and Waiver constitutes a complete and affirmative defense to any action asserting any Claims and that any such action shall be dismissed with prejudice upon presentation of this Release and Waiver.

I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that I may be exposed to or infected by COVID-19 by visiting or coming on to the organizations property, staff, volunteers, contractors, board of directors, and animals and that such exposure or infection may result in personal injury, illness, permanent disability, and/or death. 

I understand that the risk of becoming exposed to or infected by COVID-19 may result from the actions, omissions, or negligence of myself and others, including, but not limited to, the organizations employees, volunteers, officers, board of directors, affiliates, including any employees and/or independent subcontractors, subcontracted companies or any other persons and program participants and their families.

I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to myself for (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I may experience or incur in connection with my attendance or presence at the organizations or participation in the organizations programming, events, or appointments (“Claims”). 

I hereby release, covenant not to sue, discharge, and hold harmless Wildlife Learning Encounters, its employees, volunteers, subcontractors, agents, and representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. 

I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of the organization, its employees, agents, and representatives, officers, board of directors, affiliates, including any employees and/or independent subcontractors, subcontracted companies or any other persons whether a COVID-19 infection occurs before, during, or after participation in any program, event, or appointment.

Indemnification

By hiring Wildlife Learning Encounters and/or any of its affiliates, client (and/or any person or organization reserving any form of entertainment) the client acknowledges that he/she has had the opportunity to read and understands, agrees with and accepts all these terms and conditions stated above. Client, and/or any person or organization renting ANY equipment(s), live animals, or entertainment services including any “Shows”,  agrees to HOLD HARMLESS, “Wildlife Learning Encounters” as well as any of its officers, board of directors, affiliates, including any employees and/or independent subcontractors, subcontracted companies or any other persons from and against any and all liability and/or any losses, costs, damages, expenses, including attorney’s fees, on account of any and all lawsuits, claims, including claims of any trademark or copyright infringement(s) or claims for personal injury, illness or death.

Summer Camp
Covid-19

I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that I, my child, my dependents and others may be exposed to or infected by COVID-19 attending, visiting or having dependents visit the summer camp and/or coming into contact with property, staff, volunteers, contractors, board of directors, and animals and that such exposure or infection may result in personal injury, illness, permanent disability, and/or death. 

I and my child(ren) understand that the risk of becoming exposed to or infected by COVID-19 may result from the actions, omissions, or negligence of myself and others, including, but not limited to, the organizations employees, volunteers, officers, board of directors, affiliates, including any employees and/or independent subcontractors, subcontracted companies or any other persons and program participants and their families.

 I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to my child(ren) or myself for (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I may experience or incur in connection with my attendance or presence at the organizations or participation in the organizations programming, events, or appointments (“Claims”). 

 On my behalf, and on behalf of my children, I hereby release, covenant not to sue, discharge, and hold harmless Wildlife Learning Encounters, its employees, agents, volunteers, board of directors, subcontractors, subcontracted companies and representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. 

I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of the organization, its employees, agents, and representatives, officers, board of directors, affiliates, including any employees and/or independent subcontractors, subcontracted companies or any other persons whether a COVID-19 infection occurs before, during, or after participation in any program, event, or appointment.

I and my child(ren) agree to stay home and/or cancel should I have personally exhibited or have been in contact with someone who has presented with illness within the previous 1 hours to 3 weeks, including; cough, sneezing, fever, chest congestion or additional signs of potential spread of any virus or bacteria/disease. In addition, I will follow the recommendations of my provider once I have notified them of these risks in regards to my future services or attendance during this pandemic.

I accept sole responsibility for any injury to my child or myself or any member of my household (including, but not limited to, personal injury, illness, disability, and death), damage, loss, claim, liability, or expense, of any kind arising from infection or exposure to any contagious disease, including the coronavirus, that I or my child or any member of my household may experience or incur arising out of or related to with my child’s attendance at Wildlife Encounters Summer Camp or participation in Program activities (“Claims”). ON MY OWN BEHALF, AND ON BEHALF OF MY CHILD, I HEREBY FOREVER RELEASE, COVENANT NOT TO SUE, DISCHARGE, INDEMNIFY, AND HOLD HARMLESS Wildlife Learning Encounters (INCLUDING ITS SUCCESSORS, ASSIGNS, CURRENT AND FORMER OFFICERS, EMPLOYEES, INDEPENDENT CONTRACTORS, BOARD OF DIRECTORS, VOLUNTEERS, SERVANTS, AGENTS, ATTORNEYS, INSURANCE CARRIERS, AND SELF-INSURANCE POOLS) FROM ANY CLAIMS, AND WAIVE ANY AND ALL RIGHTS TO ASSERT SUCH CLAIMS, INCLUDING ANY AND ALL LIABILITIES, ACTIONS, DAMAGES, COSTS, OR EXPENSES OF ANY KIND OF EVERY NATURE ARISING OUT OF OR RELATING THERETO. I agree that presentation of this Release and Waiver constitutes a complete and affirmative defense to any action asserting any Claims and that any such action shall be dismissed with prejudice upon presentation of this Release and Waiver.

Statement of Understanding

*Camp hours are from 9:00am to 3:30pm.  Drop off is from 8:30am to 9:00am.  Pickup is from 3:30pm to 4:00pm.  If you need to pick up early let us know and we can arrange that.  

* I am aware that certain activities are physically demanding. (If you have concerns regarding your child’s abilities to participate fully, please contact the Camp Director.) I have noted that the most activities are conducted outside, in all kinds of weather. I will send my child to camp with the appropriate equipment, such as rain gear, sturdy shoes, protective clothing, sunscreen, water bottles, etc. I further understand that equipment, clothing, backpacks, coolers, etc. will experience heavy wear and tear. I understand that both my child and their belongings may come home wet, dirty, muddy, and tired.

*I understand that the Wildlife Encounters is not responsible for their loss or misplacement of any personal items campers bring to camp including but not limited to money, video games, toys, electronic devices, cell phones, trading cards, jewelry, and personal sporting equipment .

* I understand that clothing, towels, shoes, coolers, swimsuits, and water bottles will be marked with the child’s name. I understand the Company is not responsible for their loss or misplacement.

* I understand that my child may not be released to anyone without prior written documentation and presentation of a valid photo identification.

* I understand that the Wildlife Encounters staff cannot withhold a child from a biological or custodial parent without legal documentation (i.e. court orders, custody papers, etc.)

*  I understand that my child may be expelled if me, any member of my family or my child verbally or physically threatens another camper or staff.

* I understand some specific hazards that may be encountered during the course of a normal camping day may include: slipping or falling, insect bites, ticks, poison ivy, or bodily injury. I understand and recognize the element of risk inherent in any adventure program, sport, or activity associated with the outdoors. I certify that my child is capable of participation in all of the daily activities and I agree to reinforce the established safety rules and procedures.

* I understand that credits will not be issued for any absences. Credits will only be issued for program closings due to severe weather or other facility closings where other arrangements have not or could not be made by the Wildlife Encounters.  

* The information given in the registration and medical information paperwork is correct and complete to the best of my knowledge and the person herein described has permission to engage in all activities in the program, except as noted. (all necessary and important medical information regarding my child has been documented on the medical forms provided in the registration paperwork.)

* I give my permission for my child to take part in the field trips and activities provided by the Day Camp program. I understand that my child will walk, or be transported by Wildlife Encounters vans or busses.

* I understand Wildlife Learning Encounters may photograph or video record my child for promotional or onsite activity purposes.

*I understand my child may not be able to participate in camp if they exhibit symptoms resembling Covid-19 or other illnesses.  

* I agree to hold harmless Wildlife Learning Encounters as well as any of its officers, board of directors, affiliates, including any employees and/or independent subcontractors, subcontracted companies, volunteers or any other persons from and against any and all liability and/or any losses, costs, damages, expenses, including attorney’s fees, on account of any and all lawsuits, claims, including claims of any trademark or copyright infringement(s) or claims for personal injury, illness or death.

Photo Release

I grant permission to Wildlife Encounters, its agents, and its employees the irrevocable and unrestricted right to produce photographs and video taken of my child, myself, and members of my family while at Wildlife Encounters Day Camp for any lawful purpose including publication, promotion, illustration, advertising, trade, or historical archive in any manner or in any medium by Wildlife Encounters. I hereby release Wildlife Encounters and its legal representatives from liability for any violation or claims relating to said images or video.

Waiver

Guardian wishes Minor to participate in the Recreational Activity provided by the Wildlife Learning Encounters commonly known as the Wildlife Encounters and/or Wildlife Encounters Summer Camp. In consideration for the privilege of in this activity, Guardian agrees to the following clauses:

(A) Guardian certifies that Minor is physically capable of participating in the Wildlife Encounters Day Camp and that he/she will take responsibility for physical fitness and capability to perform under the normal conditions of Wildlife Encounters Day Camp.

(B) Guardian has hereby been made aware that Minor’s participation in Wildlife Encounters Day Camp has the following non-exhaustive list of particular risks: cardiovascular stress, sprains, strains, abrasions, allergy symptoms, dislocations, fractures, concussions, contusions, blisters, paralysis, death, and injury during travel to and from field trip sites, and the reckless conduct of other Recreational Activity participants.

(C) Guardian, with the intention of binding him/herself and Minor and their respective heirs, legal representatives, and assigns, assumes all risks, both known and unknown, even if arising from the negligence of the releases, in connection with participation in Wildlife Encounters Day Camp and hereby releases all instructors, agents, operators and officials of Wildlife Encounters from liability to the fullest extent permitted by law for any injury or damage which may befall Minor while participating in Wildlife Encounters Day Camp, and agrees to save and hold harmless Wildlife Encounters, and its heirs, legal representative, successors and assigns against loss from any further claims, demands or actions that may subsequently be brought by Minor or by any other person or persons arising out of the Minor’s participation in Wildlife Encounters Day Camp.

(D) In case of medical emergency, Guardian authorizes Wildlife Encounters or its representatives to take all reasonable steps to secure the health and safety of Minor, including, but not limited to first aid, ambulance transportation, x-ray examinations, anesthetic, medical or surgical diagnosis or treatment, and/or hospital care.

Guardian certifies that he/she is of lawful age and legally competent to sign this affirmation and release and that he/she understands that the terms contained herein are contractual and not mere recitals.
